Legal, political moves to defend freedom of religion

The Moorthy case which started off as a legal wrangle and progressed into a constitutional crisis, needs a political solution.

The lawyers representing Moorthy’s family plan to seek the support of all political parties to help defend Article 8 of the constitution which provides for the freedom of religion subject to other parts of the constitution.

Article 121(1A) which separates the jurisdictions of civil and syariah courts is “unconstitutional,” says A Sivanesan, a lawyer for the family.

“We are not questioning Islam or the rights of Muslims… We are saying non-Muslims should have legal remedy,” malaysiakini quotes him as saying.

“It looks like the constitution is unconstitutional. We want something to be done. We want the law to be changed. ”

The notice of appeal against the High Court decision had been filed yesterday morning.

M Manoharan, another lawyer for the family, wants the Court of Appeal to declare Article 121(A) unconstitutional.

  1. If Freedom of Religion does not include the choice of Religion(of entrance and exit)it is just a mouthful of hollow expression. Words without substance as those from the useless and corrupt UN.
